Terms and conditions for use of UCAS plug-ins

These are the terms and conditions (the ‘Terms’) on which you may make use of the UCAS Tariff Calculator (the ‘Tariff Calculator’) and the UCAS Widget (the ‘Widget’) (the Tariff Calculator and the Widget together, being the ‘Plug-ins’). Please read these Terms carefully before you embed or use the Plug-ins. By embedding and using the Plug-ins, you confirm that you accept these Terms and that you agree to abide by them.

If you do not agree to these Terms, please do not embed or use the Plug-ins.


1. About UCAS

1.1 We are the Universities and Colleges Admissions Service, a company incorporated in England and Wales with company number 02839815 whose registered office is at Rosehill, New Barn Lane, Cheltenham, Gloucestershire, GL52 3LZ (‘UCAS’, ‘we’, ‘us’).

1.2 You can contact us by telephone on 0371 468 0 468, using our contact us page, or in writing to the above address.

1.3 Our role is to provide admissions services across a range of subject areas and study modes for education providers.


2. Changes to the Terms

2.1 We reserve the right at all times to vary, change, alter, amend, add to or remove any of these Terms. Please ensure that you review these Terms each time you embed or use the Plug-ins as you will be deemed to have accepted a variation if you continue to use the Plug-ins after the variation has been posted.

2.2 The current draft of these Terms was adopted and published on 20 April 2016


3. Embedding and downloading the Plug-ins

3.1 UCAS permits you to embed the Plug-ins onto web pages or virtual learning environments (‘VLEs’):

3.1.1 by using the code provided on the UCAS Widget page 

3.1.2 by downloading the UCAS Tariff API

in order to deliver UCAS-originated content to users of your web page or VLE.

3.2 In respect of the Tariff Calculator (but not, for the avoidance of doubt, the Widget), UCAS permits you to develop, customise and extend the Tariff Calculator for use on your web page or VLE. UCAS will provide an up-to-date list of qualification points annually. You are not permitted to change qualification points or remove qualifications from the list. You may add pop-up boxes and help text to students explaining that you do not accept certain qualifications that are on the UCAS Tariff list but you are responsible for ensuring students are not confused or misled into thinking that all other providers will not accept these qualifications. For example, if you choose to flag certain qualifications are not acceptable for your courses, it may be appropriate to redirect users to the UCAS Tariff Calculator on www.ucas.com.

3.3 You will not deploy the Plug-ins in any way other than as set out in clauses 3.1 or 3.2 above without first obtaining permission in writing from us.

3.4 We reserve the right at any time to require you to remove either or both of the Plug-ins from your web pages and/or VLEs on reasonable notice and reserve the right, at any time, to suspend or terminate your access to, or use of, the Plug-ins.


4. Grant of licence

4.1 We hereby grant you a non-exclusive, non-transferable, limited and revocable licence to embed the Plug-ins onto your web page and/or VLE, for the purpose of providing users of your web page and/or VLE with UCAS-originated content.

4.2 You shall not or shall not permit any third party to:

4.2.1 modify or adapt the Widget

4.2.2 remove, alter or disable the links embedded within the Widget

4.2.3 remove, alter or disable any analytical or tracking tool embedded in the Widget

4.2.4 display the Plug-ins or data returned by using them in any context that could reasonably be inferred to bring UCAS into disrepute or damage its reputation, goodwill or brand

4.2.5 use the Plug-ins for any other purpose than as set out in clauses 3.1 or 3.2 above


5. Intellectual property rights

5.1 All copyright and other intellectual property rights in any content delivered by using the Widget or the unmodified Tariff Calculator is either owned by us or has been licensed to us by the rights owners. The Widget and unmodified Tariff Calculator contain trademarks which belong to us or which have been licensed to us by the trademark owners, for use in the Widget and unmodified Tariff Calculator. Use of these trademarks other than as used in the Widget and unmodified Tariff Calculator is forbidden, unless prior written permission has been obtained from the trademark owner.

5.2 You may not remove any copyright, trademark or intellectual property notices contained in any original material downloaded or copied from the Widget or the unmodified Tariff Calculator.

5.3 We will seek criminal prosecution of any individual who, or organisation which, seeks to use UCAS' name, material, logos or trademarks for unlawful purposes and, where appropriate, will take action within the civil courts of any applicable jurisdiction against any individual or organisation discovered to be using UCAS' name, logos, trademarks or the Plug-ins for unauthorised or unlawful purposes.

5.4 Any rights not expressly granted herein are reserved by UCAS.


6. Disclaimer and limitation of liability

6.1 UCAS has taken care to ensure that the information in the Plug-ins and the data returned using them is correct. However, no warranty, express or implied, is given as to its accuracy and UCAS does not accept any liability for error or omission. UCAS is not responsible for how the information is used, how it is interpreted or what reliance is placed on it. We do not guarantee that the information on the Plug-ins or the data returned using them is fit for any particular purpose.

6.2 The content of and data returned using the Plug-ins is indicative and for general information only and does not constitute any form of advice or recommendation upon which a specific decision should be made. UCAS has taken steps to ensure the accuracy and currency of the Plug-ins, but to the fullest extent permitted by law UCAS hereby excludes any warranty, whether express or implied, by statute, at common law or otherwise, relating to the Plug-ins and the material contained on the Plug-ins. In particular (but without limitation of the above), UCAS gives no warranties as to quality, accuracy, timeliness, completeness or fitness for a particular purpose of the Plug-ins or of the material contained in them.

6.3 UCAS will try to make the Plug-in content available but cannot guarantee that the Plug-ins will operate continuously or without interruptions, or be error-free, and can accept no liability for their unavailability. You must not attempt to interfere with the proper working of the Plug-ins and in particular, you must not attempt to circumvent security, tamper with, hack into, or otherwise disrupt any computer system, server, website, router or any other internet connected device. You are also advised to use the appropriate antivirus software before and during access to the Plug-ins.

6.4 To the fullest extent permitted by law, UCAS shall not be liable for any claims, costs, penalties, loss (whether direct, indirect or consequential and whether economic or special loss of any nature), damages or expenses arising from the use of or from the inability to use the Plug-ins. UCAS does not accept liability from reliance on information or advice contained in the Plug-ins or from any unauthorised access or alteration to the Plug-ins by a third party.

6.5 We shall have no liability to you for any breach of these Terms caused by any event or circumstance beyond our reasonable control, including, without limitation, strikes, lock-outs, or other industrial disputes, breakdown of systems or network access, or flood, fire, explosion or accident.

6.6 Nothing in these Terms shall exclude liability for death or personal injury directly caused by our negligence, nor any other liability which cannot be excluded or limited under applicable law. 


7. General

7.1 These Terms are not intended to confer any benefit on a third party under the provision of the Contracts (Rights of Third Parties) Act 1999.

7.2 These Terms shall be construed and interpreted in accordance with the laws of England and Wales. The courts of England shall have exclusive jurisdiction in relation to any claim, dispute or other matters arising therefrom, without prejudice to UCAS' right to bring proceedings in the courts of the country of residence of any user of the Plug-ins.

7.3 If any provision of these Terms is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms which shall continue to have full force and effect.

7.4 The failure by us to exercise any right or remedy under these terms and conditions shall not constitute a waiver of that right or remedy.
